Disclaimer of Liability

Distraal B.V. disclaims liability for damages, delays, or limitations that may arise in the context of its dropshipping services. The following terms define the limits of Distraal's legal responsibility.

1. Force Majeure and Delivery Delays

  • Distraal B.V. is not responsible for delivery delays caused by force majeure events such as natural disasters, strikes, wars, pandemics, customs delays, or disruptions from third-party providers.
  • Delivery delays caused by shipping carriers are not the responsibility of Distraal B.V., although the company will aim to inform partners and offer alternative solutions where possible.

2. Indirect Damages

  • Distraal B.V. shall under no circumstances be held liable for indirect or consequential damages including but not limited to:
    • Loss of profit
    • Loss of customers
    • Brand or reputation damage
    • Suspension of an online shop or sales channel
    • Incidental, punitive, or exemplary damages

3. Limitation of Liability

  • In all cases, Distraal B.V.'s total liability is limited to the total subscription fees paid by the partner in the last 12 months.
  • This limitation applies to all claims, including direct damages, data loss, or financial losses.

4. Risks from Third-Party Content

  • Some product descriptions, images, or technical information on the Distraal platform may be provided by third-party suppliers.
  • Distraal B.V. is not responsible for damages resulting from copyright infringement, trademark violations, or misleading content originating from external sources. Responsibility lies fully with the partner.

5. Image and Brand Usage

  • Product images, descriptions, and brand elements may be provided by third-party suppliers and remain the intellectual property of their respective owners.
  • Distraal B.V. provides no warranty or guarantee regarding the copyright or trademark compliance of such materials.
  • It is the partner's sole responsibility to ensure they have the legal right to use any brand logos, images, or trademarks.
  • Any infringement, takedown notice, legal claim, or platform suspension resulting from the use of such materials is entirely the partner's liability.
  • All content provided by Distraal is licensed only for use during the active term of the partnership and exclusively for the promotion of Distraal products. Upon termination, all materials must be removed from the partner's platforms.
